This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have (...) been deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Trust in vaccination is eroding, and attitudes about vaccination have become more polarized. This is an observational study of Twitter analyzing the impact that COVID-19 had on vaccine discourse. We identify the actors, the language they use, how their language changed, and what can explain this change. First, we find that authors cluster into several large, interpretable groups, and that the discourse was greatly affected by American partisan politics. Over the course of our study, both Republicans and Democrats entered the (...) vaccine conversation in large numbers, forming coalitions with Antivaxxers and public health organizations, respectively. After the pandemic was officially declared, the interactions between these groups increased. Second, we show that the moral and non-moral language used by the various communities converged in interesting and informative ways. Finally, vector autoregression analysis indicates that differential responses to public health measures are likely part of what drove this convergence. Taken together, our results suggest that polarization around vaccination discourse in the context of COVID-19 was ultimately driven by a trust-first dynamic of political engagement. (shrink)

In this article, Laura Quintana elaborates on a conceptual distinction between violence and rage. Along with this distinction, she recognises that while rage may possess a destructive potential, it can also be politicised in emancipatory practices that confront conditions of injustice and structural violence. Her analysis centers on contemporary political movements in Latin America, which she views as collective manifestations of rage. Within these movements, the manifestation of rage is intertwined with forms of care and communal labor. Quintana (...) characterises such movements as embodying a “dignified rage” (digna rabia) that calls for an emancipatory transformation of the status quo. She contends that these practices can be understood in terms of the notion of “anti-violence,” as it has been coined by Étienne Balibar. In this she diverges from Judith Butler, since, according to Quintana’s analysis, such practices challenge the demand for non-violence that has often served to neutralise the disruptive force of such manifestations and movements. As various forms of artificial intelligence become increasingly integrated into our daily lives, understanding the ethical challenges that can be met by the development of human-centered AI is vital. This paper investigates the intersection of the philosophy of technology, moral philosophy, and user experience design to explore points of interaction between humans and machines. The paper suggests that examining the context in which AI is often deployed, including social and digital environments, offers a rich vein for examining the mechanisms underlying (...) ethical issues in AI. Finally the paper identifies concerns in the ethics of technology that complement issues arising in the development of human-computer interactions and explores a notion practice that can frame design as concerned with human values. By examining these intersections, I hope to offer insights that can aid in the deployment of human-centered AI. (shrink)

Epidemiological models directly shape policy responses to public health crises. We argue that they also play a less obvious but important role in solving certain coordination problems and social dilemmas that arise during pandemics. This role is both ethically and epistemically valuable. However, it also gives rise to an underappreciated dilemma, as the features that make models good at solving coordination problems are often at odds with the features that make for a good scientific model. Many philosophers hold that generics (i.e., unquantified generalizations) are pervasive in communication and that when they are about social groups, this may offend and polarize people because generics gloss over variations between individuals. Generics about social groups might be particularly common on Twitter (X). This remains unexplored, however. Using machine learning (ML) techniques, we therefore developed an automatic classifier for social generics, applied it to 1.1 million tweets about people, and analyzed the tweets. While it is often suggested that generics (...) are ubiquitous in everyday communication, we found that most tweets (78%) about people contained no generics. However, tweets with generics received more “likes” and retweets. Furthermore, while recent psychological research may lead to the prediction that tweets with generics about political groups are more common than tweets with generics about ethnic groups, we found the opposite. However, consistent with recent claims that political animosity is less constrained by social norms than animosity against gender and ethnic groups, negative tweets with generics about political groups were significantly more prevalent and retweeted than negative tweets about ethnic groups. Our study provides the first ML-based insights into the use and impact of social generics on Twitter. (shrink)

In this paper I present a formalization of the theory of ideal concepts applied to the concept of God. It is done within a version of the Simplest Quantified Modal Logic (SQML) and attempts to solve three meta-problems related to the concept of God: the unicity of extension problem, the homogeneity/heterogeneity problem and the problem of conceptual unity.

Epistemologies have power. They have the power not only to transform worlds, but to create them. And the worlds that they create can be better or worse. For many people, the worlds they create are predictably and reliably deadly. Epistemologies can turn sacred land into ‘resources’ to be bought, sold, exploited, and exhausted. They can turn people into ‘labor’ in much the same way. They can not only disappear acts of violence but render them unnamable and unrecognizable within their conceptual (...) architectures. Settler systems of epistemic and conceptual resources and the relations among them are constructed to preclude certain forms of knowledge. This is not an accident; it is a central goal of colonial violence. Colonization and land dispossession would not be possible without the violent disruption of Indigenous knowledge systems and ongoing organized attempts to disrupt their survival. Violently disrupting the relationships of people to land is as much an epistemic project as it is a material one, and these two projects are inherently linked. The task of theorizing epistemic oppression is not only about epistemic oppression. Epistemic oppression is a story that gives language to a phenomenon in order to get past it, to carry on with the maintaining and reviving the forms of Indigenous and diasporic knowledge that colonialism has worked tirelessly to corrupt and silence. This paper aims to meet an objection that has been raised against structural empiricism known as the “loss of reality objection.” I argue that an inferential approach to scientific representation allows the structural empiricist to account for the representation of phenomena by data models and ensures that such a representation is not arbitrary. By the notions of immersion, derivation, and interpretation, I show how data models are able to represent phenomena in a non-arbitrary manner. I conclude this paper with a (...) programmatic outline of a view that arises from the theses defended throughout the article and that I would like to call “semantic structuralism.”. (shrink)

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. In this essay, I focus on Lugones’s relatively lesser explored notion of playfulness. I weigh in on the debate about whether playfulness is necessary for what Lugones calls “world-traveling,” which enables one to recognize another person as a full subject. I argue that although the attribute of playfulness may not be necessary for world-traveling, it is necessary for collaborative world-making––creating a new, shared world that is opened through the activity of play.

Ubico indicios de mitos nacionales analizando obras narrativas (de Borges y algunos otros autores), y dichos acerca de Borges, centrándome en cómo se verifica, en la narrativa de Borges, (y también en sus intervenciones públicas y en lo que se dice sobre su figura) la irrupción del peronismo. Propongo un cambio de escala: sin intentar interpretar los grandes momentos constitutivos entendiéndolos como mitos de origen, intento constituir series, de características cuasi-míticas, a partir de poner en relación a breves sintagmas que (...) se reiteran en distintas unidades narrativas. Elementos transversales, que van de un relato a otro. Sintagmas que se analizan tomando al conjunto de la obra de Borges como paradigma, y no sólo relatos aislados. En primer término, exploro ciertas constantes en algunos relatos del período 1945-54. Luego me detengo en una serie de versiones contemporáneas sobre un Borges ciego a quien un joven peronista ayuda a cruzar la calle. En tercer lugar. el tema de la aparición de relatos oníricos, literariamente enunciados, sobre personas con garra de pájaro, vinculándolos a los dilemas morales de la élite intelectual en los tiempos del primer peronismo. En tanto estos conjuntos tienen mucho en común con los mitos al ser reelaboraciones sucesivas de un elemento narrativo, podrían ser abordadas con métodos de análisis míticos propios de la antropología estructural. No obstante, el material utilizado tiene diferencias con las mitologías clásicas: a) tiene versiones orales, pero también escritas; b) hechos ficcionales, pero también históricos; c) admiten un orden cronológico verificable. Por lo tanto, arriesgo aquí una exploración metodológica y teórica más bien experimental, aunque deudora de Lévi-Strauss. Concluyo que en estos dos conjuntos se verifica el funcionamiento un sistema ideológico, que es el de la formación nacional argentina, con sus tensiones y crisis. (shrink)

Protests and counter-protests seek to draw and direct attention and concern with confronting images and slogans. In recent years, as protests and counter-protests have partially migrated to the digital space, such images and slogans have also gone online. Two main ways in which these images and slogans are translated to the online space is through the use of emoji and hashtags. Despite sustained academic interest in online protests, hashtag activism and the use of emoji across social media platforms, little is (...) known about the specific functional role that emoji and hashtags play in online social movements. In an effort to fill this gap, the current paper studies both hashtags and emoji in the context of the Twitter discourse around the Black Lives Matter movement. (shrink)

The question of how the probabilistic opinions of different individuals should be aggregated to form a group opinion is controversial. But one assumption seems to be pretty much common ground: for a group of Bayesians, the representation of group opinion should itself be a unique probability distribution, 410–414, [45]; Bordley Management Science, 28, 1137–1148, [5]; Genest et al. The Annals of Statistics, 487–501, [21]; Genest and Zidek Statistical Science, 114–135, [23]; Mongin Journal of Economic Theory, 66, 313–351, [46]; Clemen and (...) Winkler Risk Analysis, 19, 187–203, [7]; Dietrich and List [14]; Herzberg Theory and Decision, 1–19, [28]). We argue that this assumption is not always in order. We show how to extend the canonical mathematical framework for pooling to cover pooling with imprecise probabilities by employing set-valued pooling functions and generalizing common pooling axioms accordingly. As a proof of concept, we then show that one IP construction satisfies a number of central pooling axioms that are not jointly satisfied by any of the standard pooling recipes on pain of triviality. In this paper I intend to show that the confluence of such motifs, Kantian and Hegelian, in Habermas’ thought allows us to detect the keys to a conception of what should be and the ideal (...) that does justice to the two essential features of what is really posible: the refence to the future and to conditions embedded in the real. Sexting has been defined as sending, receiving, or forwarding sexually explicit messages, images, or photos to others through digital platforms, and can assume more consensual or more abusive and violent forms. This study aims to explore the prevalence of abusive sexting in Portuguese adolescents and the psychological characteristics of sexting abusers in terms of emotional and behavioral problems, potential markers of psychopathy, childhood trauma and maltreatment, and different forms of aggression. A cross-sectional study was conducted with 4,281 participants, aged 12–20 (...) years, of whom 204 engaged in abusive sexting behaviors and 182 self-identified as being a non-consensual sexting victim. Abusive sexting was more common among boys and middle adolescents, and abusive sexting victims were more likely to be children of single-parent families. Engaging in abusive sexting and being a victim of abusive sexting were also related to behavioral and emotional problems, callousness, experiences of neglect and abuse in childhood, and various forms of aggression. Any plausibly just market exchange must balance two conflicting moral considerations: non-worseness (Wertheimer, 1999) and euvoluntariness (true voluntariness; Munger, 2011). We propose an analytical theory of just market exchange that partly resolves this conflict.

The objectives of the present study were to adapt a grief intervention program to family caregivers of patients with dementia, and assess its effectiveness in improving the symptoms of grief and other health-related variables. The intervention was based on Shear and Bloom's grief intervention program, with the necessary adaptations for use in the grieving process for a family member's illness. A total of 52 family caregivers of individuals with dementia participated. They were evaluated using a battery of self-report measures assessing (...) grief, overload, resilience, post-traumatic growth, experiential avoidance, health-related quality of life, and benefits of care. The results suggest that the program is effective in improving grief symptoms, caregiver burden, resilience, post-traumatic growth, and quality of life of family caregivers. It is necessary to create and implement interventions targeting caregivers' feelings and manifestations of ambiguous grief, because there is a lack of programs providing an efficient solution for the mental and physical health of caregivers, and because of the human and socioeconomic cost involved in neglecting this group.
